Legislative Agenda for 2007

Local Law #1:      Enforcement of Uniform Fire and Building Codes

              This was a minor local law to bring the Town of Milan's Municipal Code
              in compliance with the current New York State Fire Safety and Building Codes.

Local Law #2:       Amendment to Chapter 105, Unsafe Buildings

               This was a minor clarification of terminology to bring town code into compliance
               with state law.

Local Law #3:        Vending of Refreshments 

                This was a to establish a permitting system to allow vending of refreshment
                along roads within the town.

Local Law #4:         Hiring of Personnel Outside of Town

                This law allows the town to hire certain personnel from
                outside of the town's geographic boundaries. This applies
                to the Justice Clerks, Deputy Town Clerk, and Code Enforcement
                Officer.

Local Law #5:        Amendment to Article X, "Referral and Amendment Procedures"

                This law modifies the procedures the town must follow in referring certain actions to
                the County and Town planning boards. This law corrects inconsistencies in town
                law related to these procedures. The law was adopted 8/13/07.

How Legislation becomes Law in Milan            

The Town Board is empowered to pass local laws. The procedure to adopt or pass the law is to:

1:     Prepare a draft for circulation amongst board members and other interested and  appropriate parties.

2.    When laws is drafted and reviewed, pass a resolution to introduce the law  and set the date for Public Hearing and Public Comment Period.
                Note that if there is a SEQR action,
                there is an additional set of steps
                besides those indicated here

3.      The Law is available for review at the Town Hall and on the Town's Website

4.      Certain review procedures apply depending on type and significance of the law. These might include review by Planning Board and Dutchess County Planning Department.

5.      Public Hearing to allow the townspeople a chance to speak

6.      Review of all public comments

7.      If Law is significantly altered after review, then repeat steps starting at step 2

8.      Resolution to Adopt or Reject Law
